The Central Administrative Tribunal (CAT), established in 1985 to ensure legal review and justice in administrative matters, is facing a series of challenges that have raised concerns about its credibility and efficiency.
One of the key issues is the inconsistency and perceived bias in the judgements made by the CAT. This has led to criticism and a loss of confidence in the tribunal, creating confusion and undermining its credibility.
The Delhi High Court has emphasised the need for the CAT to focus on examining cases on their merits, rather than dismissing them on technicalities. This is a call for the tribunal to uphold fairness and impartiality in its decision-making process.
However, the CAT is operating with only half of its sanctioned strength, according to a Parliamentary committee report. This staffing shortage, coupled with administrative and infrastructure inefficiencies such as a lack of courtrooms, support staff, and technological resources, is hampering the smooth functioning of the CAT.
The pendency of more than 1 lakh cases before the CAT is another significant challenge. To address this issue, implementing e-filing and digital case management systems has been suggested as a way forward.
The Madras Bar Association, in 2021, challenged the Tribunal Reforms Act and called for reforms in administrative tribunals like the CAT. The Calcutta High Court also set aside an impugned case transfer order passed by the principal bench of the CAT against a former Bengal Chief Secretary in the same year.
Allegations of political interference and lack of autonomy in the CAT's day-to-day administration have also been made. The Supreme Court recently remarked that the tribunal should not function as a wing of the executive, emphasising the need for its independence.
Despite these challenges, the government-founded organisation continues to serve the interests of the public by ensuring legal review and justice in administrative matters. It is hoped that the necessary reforms will be implemented to address the issues facing the CAT and restore its credibility and efficiency.
