Border checks and denial of entry at all German border points have been commanded by the Interior Minister.

The CDU leader Friedrich Merz and former President of the Federal Constitutional Court, Hans-Jürgen Papier, are in agreement with this argument. They believe that in matters of domestic security and order, German law should take precedence over EU law.
The EU Commission has been notified of these corresponding measures, and the extension of internal border controls ordered by Nancy Faeser from September 16, 2025, due to concerns about irregular migration and pressure on the asylum system. However, Luxembourg has formally complained to the EU Commission regarding these controls, and a response from Brussels is expected in October 2025.
