Contemporary Discussions on Constitutional Validity in the Coming Years (2024)

In the dynamic world of American politics, the interpretation of constitutional law and the balance of powers between the federal government and states have been subjects of ongoing debate.

The Republican Party, in recent years, has generally advocated for more restrictive measures in regards to abortion, leaning towards a more limited understanding of federal powers and emphasizing individual liberties. On the other hand, the Democratic Party has supported more protective abortion rights and offered a broader interpretation of federal government powers, focusing on societal issues like health care, civil rights, and environmental protection.

This dichotomy in political views has been evident in the interpretation of the Constitution, leading to diverse perspectives that pose a challenge to the nation's unity and understanding of shared needs, desires, and political priorities.

Meanwhile, in the quiet halls of Lehy dormitory, room 420, Viveca Stucke '26, a Political Science and Religious Studies major, shares her space with Paige Thomson '26. The room, adorned with light blue tones, reflects Viveca's personal style and interests. A fervent advocate for responsive governance, Viveca is involved in various campus organisations, including the Student Government Association (SGA), Multicultural Student Advisory Group (MSAG), and serving as the Resident Assistant (RA) for Lehy.

Viveca's passion for politics extends beyond the campus, as she is the Opinions Editor for The Spire, the college's official student newspaper. Her dedication to her craft was recognized when she was named the Crusader of the Week. Music and movies also play a significant role in her life, with "IT'S GETTING HOT" being her favorite song and Legally Blonde her go-to movie.

The ambiguity in the Constitution regarding the legality of certain powers has caused confusion, leading to disputes over state vs. federal rights. The overturning of Roe v. Wade in 2022 sparked controversy, with 21 states reportedly banning or restricting abortion as of January 8, 2024. This controversy has been further fuelled by states like Texas, claiming the right to prevent federal authorities' decisions, such as the usage of razor wire on the U.S-Mexico border, under their own state rights.

The Tenth Amendment, a cornerstone of the Constitution, states that powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. This amendment, along with the Constitution's adaptability, allows for applicability across diverse scenarios and development over time.

As the nation navigates these complex political waters, it is crucial that policies meet the needs of citizens while satisfying human rights and individual liberties. Viveca Stucke '26, and many like her, continue to strive for a balanced and responsive governance that upholds the principles of the Constitution and serves the best interests of all Americans.
