Court affirms $83 million ruling against Trump for slandering E. Jean Carroll
In a series of legal victories for E. Jean Carroll, a jury in 2023 sentenced Donald Trump to pay $5 million in damages for sexual abuse and defamation, while a New York appeals court confirmed an $83.3 million judgment against Trump for defaming Carroll in 2019.
The legal saga began in 2019 when Carroll accused Trump of defaming her in a social media post. In the 2023 trial, Trump was found liable for defaming Carroll in the said post, and the court also rejected his argument that he was entitled to presidential immunity. The court's decision does not address any other legal matters involving President Donald Trump.
The court's ruling upholds the earlier ruling that Trump defamed Carroll in 2019. The three-judge panel decided that Trump acted with reckless disregard for the truth when he called Carroll a liar and said she's not his type. The opinion stated that there was ample evidence that Trump was recklessly indifferent to Carroll's health and safety.
The attacks against Carroll on social media and emails occurred after Trump released his statements, receiving thousands of such attacks, including hundreds of death threats. Carroll received threats of death after Trump's statements.
In a separate trial in 2023, a jury found Trump liable for the attack and awarded Carroll $5 million in damages for battery and for defaming her in a 2022 social media post. The court also found that the district court did not err in any of the challenged rulings, and the panel also rejected Trump's argument that the punitive damage award of $65 million was grossly excessive.
The panel awarded Carroll $18.3 million in compensatory damages, which they found to be fair. The court also concluded that Trump did not present any grounds to reconsider the judgment on presidential immunity.
In 2020, Trump was ordered to pay $83.3 million in damages to Carroll for defaming her in 2019. The federal appeals court in New York upheld this judgment against President Donald Trump.
Trump's attacks against Carroll continued throughout the pendency of the nearly five-year litigation and became more extreme and frequent as the trial approached. The legal battles between Carroll and Trump are not over yet, but these recent judgments represent a significant victory for Carroll in her pursuit of justice.
