Criminal Court Initial Instance
In the ongoing BES/GES trial, presided over by Judge Helena Susano, a series of requests for her removal have been made by two of the defendants. The allegations against Judge Susano claim that she had prior knowledge of depositions of defendants before they were questioned in the trial, which some defendants deem as illegal.
The BES/GES trial, which began last year at the Lisbon Central Criminal Court, involves several defendants, including the former president of BES, Ricardo Salgado, who faces approximately 60 charges. The acts in question are associated with one count of criminal association and several counts of active corruption in the private sector and qualified fraud.
The Public Ministry estimates damages of 11.8 billion euros were caused by the acts allegedly practiced between 2009 and 2014 by the defendants. The defense of the plaintiffs, however, argues that prior knowledge by the court, outside the hearing, does not generate nullity or irregularity.
The plaintiffs in the BES trial have made a request against the removal of Judge Susano, believing that the trial should continue with the current panel of judges. Two defendants have previously requested the removal of Judge Susano, citing the alleged illegal behavior as a serious and sufficient reason to question her impartiality.
However, the search results do not provide the name of the judge who served as the president of the panel for the BES/GES trial and was challenged for removal by the plaintiffs' defenders. The sessions of the BES trial that took place at the beginning of July this year are in question due to the request for the removal of Judge Susano.
The defense of the defendants, on the other hand, believes that the behavior of Judge Helena Susano was deemed illegal. The trial against the defendants, including former executives of BES and other entities of GES, has been ongoing since October 15, 2024. The BES/GES trial continues to be a subject of intense scrutiny and debate.
