Enacting the United States-Japan Treaty Agreement

The U.S. and Japan have agreed on a series of measures aimed at enhancing trade relations, as outlined in a recent order. Here are the essential details:

  1. The U.S. Secretary of Commerce has been granted the authority to establish rules and regulations that determine whether automobiles and automobile parts are considered "products of Japan" for the purpose of this section.
  2. The Secretary is also authorized to modify the reciprocal tariff rate to zero percent for certain products from Japan, including natural resources unavailable in the U.S., generic pharmaceuticals, generic pharmaceutical ingredients, and generic pharmaceutical chemical precursors.
  3. In the event that Japan fails to fulfil its commitments, the President may modify the order to address the national emergency and reduce or eliminate threats to national security.
  4. The costs associated with the publication of this order will be borne by the Department of Commerce.
  5. Any provisions of previous proclamations and Executive Orders that are inconsistent with the actions directed in this order have been superseded to the extent of such inconsistency.
  6. The Secretary's decision to modify the tariff rate must align with the national interests of the U.S., the need to deal with the national emergency, and the need to reduce or eliminate threats to national security.
  7. The U.S. Secretary of the Treasury, in consultation with the U.S. Trade Representative, has the power to make modifications to the Harmonized Tariff Schedule to implement the agreement between the United States and Japan.
  8. The Secretary and the Secretary of Homeland Security are directed and authorized to take necessary actions to implement and effectuate this order, including through temporary suspension or amendment of regulations or through notices in the Federal Register.
  9. The Secretary shall monitor the progress of Japan's implementation of its commitments under the Agreement and update the President on the status.
  10. The Secretary of Homeland Security, in consultation with the Chair of the ITC, may determine if additional modifications to the HTSUS are necessary to effectively implement this order.
  11. This order is being implemented in accordance with applicable law and is subject to the availability of appropriations.
