EU imposes temporary tariffs on electric vehicle imports from China with subsidies
The European Commission has announced that provisional countervailing duties on battery electric vehicles (BEVs) imported from China may be published by 4 July 2024. This decision comes as part of an ongoing anti-subsidy investigation initiated on 4 October 2023.
The investigation, which is expected to conclude within 13 months, aims to mitigate economic injury caused by subsidised imports and restore competitive balance within the EU BEV industry. If the investigation is successful, a Chinese company will face a provisional anti-subsidy tax rate of 38.1%. However, the specific company has not been named in the available search results.
The provisional duties, if imposed, will be added to the existing 10% import duty on BEVs, increasing the total tariff to 48.1%. By 4 July 2024, the Commission will publish a regulation detailing the provisional findings, with duties entering into force the following day.
Definitive measures will follow within four months after the publication of provisional duties. These measures will require a qualified majority vote from Member States before they can be imposed. If approved, the final duties, if imposed, will be in force for five years, ensuring long-term stability and protection for the EU BEV industry.
The Commission has taken a transparent and procedural approach to this matter, informing all interested parties, including the Chinese government and companies, EU Member States, about the intended measures. This approach aims to give all parties sufficient time to adjust and prepare for the eventual tariffs.
The imposition of provisional duties is a significant step towards protecting the EU BEV industry from subsidised imports. The Commission remains committed to ensuring a level playing field for all players in the market, fostering fair competition and promoting a sustainable and competitive European economy.
