Court Revokes Retail Sector Restrictions in North Rhine-Westphalia

In a significant ruling, the Higher Administrative Court of North Rhine-Westphalia (NRW) has revoked restrictions aimed at curbing infections in the retail sector of the region. The decision, which was based on the principle of equality being violated, may impact similar restrictions in other sectors across NRW.

The court's ruling came after an urgent application by a Media Markt branch, challenging the state's restrictions on the retail sector. The corresponding restrictions in § 11 of the North Rhine-Westphalian "Corona Protection Regulation" have been declared void.

According to the court, the state has exceeded its scope, as there is no apparent reason for differentiation in retail sector restrictions. The state's restrictions on the retail sector were deemed not justified by the court.

As a result of the ruling, there is no customer limit per square meter in the retail sector of NRW as of now. Bookstores, stationery stores, and garden centers are allowed to operate their entire range under simplified conditions, i.e., without appointment bookings or other regulations on access.

No appointment (click and collect) is required in the retail sector of NRW, providing customers with greater flexibility when shopping. This decision may have far-reaching implications, potentially impacting similar restrictions in other sectors across NRW.

The application to lift the restrictions in the Münster court ruling was filed by the tax office (Finanzamt, FA), which requested the reversal of the initial ruling and the dismissal of the claims as unfounded.
