In a significant stride towards digital transformation, France has introduced a new law known as the Competitiveness Law. This legislation, effective as of August 2023, allows for the creation, signing, and storage of transferable documents electronically.

The law establishes the principle of legal and functional equivalence between paper-based and electronic transferable documents. This means that the holder of an electronic transferable document has equivalent rights to those of the holder of a paper-based transferable document, provided the conditions set out in the Competitiveness Law are satisfied.

The law outlines the conditions for the transfer, delivery, presentation, and modification of electronic transferable documents. It introduces the concept of "exclusive control" to address the challenges of dematerialisation. The holder of an electronic transferable document is the person having exclusive control over it, enabling them to claim the performance of the rights incorporated in the transferable document, modify it, and transfer it.

A reliable method must be used for the cumulative demonstration of the uniqueness, holder's identification, establishment of exclusive control, identification of signatories and subsequent holders, and preservation of integrity and evidence of amendments in an electronic transferable document. The electronic transfer document must contain all mandatory information which would be required in the paper-based transferable document.

The Competitiveness Law sets out conditions for an electronic transfer document to have the same effects as a paper-based transfer document. Notably, an electronic transferable document has the same validity as a paper-based transferable document under the Competitiveness Law. The law also allows for the conversion of transferable documents between paper and electronic formats, given certain conditions are met. The converted document retains the properties of the original, and the original ceases to be valid on conversion.

Interestingly, the German government was responsible for passing the law to introduce "transferable documents," a move that was done with the adoption of the government draft law on August 16, 2023. However, the exact date when the law was officially passed is not explicitly stated in the search results.

In conclusion, the Competitiveness Law represents a significant step forward in France's digital transformation, paving the way for a more efficient and streamlined system for transferable documents. As the world continues to embrace digital technologies, France's move is likely to inspire similar initiatives in other countries, further enhancing global competitiveness and efficiency.
