Mall operator in New Jersey faces lawsuit for retail sales on Sunday, alleged to violate Blue Laws
In the heart of East Rutherford, the American Dream mall has found itself embroiled in a legal dispute over its Sunday retail operations. The controversy stems from New Jersey's long-standing blue laws, which have historically been far stricter than those in other parts of the state.
According to a 2011 public hearing, Tony Armlin, former vice president of development and construction for American Dream's mall owner Triple Five, cited traffic impact restrictions as the reason for the blue laws prohibiting retail activities on Sundays.
The mall's operators had reportedly assured Jim Tedesco, the executive of Bergen County, that they would keep retailers shut on Sunday before the mall opened. However, Bergen County's executive recently accused American Dream of breaking its promise by operating retail on Sundays.
The suit names East Rutherford and the New Jersey Sports and Exposition Authority as defendants. The latter declined to comment due to pending litigation. The New Jersey attorney general's office also declined to comment due to the same reason. The mayor of East Rutherford did not return a request for comment.
The blue laws in New Jersey initially extended beyond business operations, prohibiting leisure activities and nonessential travel. Proponents argued for the protection of the Sabbath from commerce and recreation. Despite most New Jersey counties having repealed their blue laws, Bergen County has resisted such attempts and the measures have been upheld by county voters. The blue laws in Bergen County exempt some services, including grocery and drug stores.
The search results do not provide information about the authority listed as the defender in the legal dispute against the American Dream mall in New Jersey. This lack of information adds another layer of intrigue to the ongoing controversy.
As the legal battle unfolds, the future of Sunday retail operations at the American Dream mall remains uncertain. The case serves as a reminder of the enduring influence of New Jersey's blue laws and the challenges they pose for modern businesses.
