Cities Near Ochtrup Challenge DOC Expansion in Court
In a move to protect their interests, the cities of Nordhorn and Gronau have decided to take legal action against the expansion of DOC Ochtrup. Yesterday, the city of Nordhorn filed a lawsuit against the expansion, with Gronau following suit after previously challenging the building permit with the Administrative Court of Münster.
The urban planning consequences for the inner cities and town centers in the catchment area are a significant concern for these municipalities. They argue that the expansion will have a detrimental impact, particularly on smaller medium-sized centers like Ochtrup, which would significantly exceed its medium-sized supply mandate with the expanded DOC.
The lawsuit will involve a norm control application against the building plan and an annulment action against the building permit. The cities and districts affected by the project have been evaluating their options since the completion of the land use planning and the issuance of the building permit.
Critics argue that the impact prognosis drawn up in connection with the expansion project underestimates the impacts of DOC. They claim that the current and future development of online trading has not been adequately taken into account, and the disadvantages for the region due to the expanded DOC are not justified.
The massive expansion plans of DOC, from 11,500 to over 19,000 m² of sales area, have been opposed by 21 municipalities and 3 districts during the planning phase. The concerns about the expansion are now being presented in court.
The neighboring municipalities have coordinated details for the legal proceedings against the expansion of DOC Ochtrup. However, the additional municipalities and districts participating in the legal assistance proceedings against the DOC Ochtrup construction project have not been publicly specified.
