In a significant development for the fishing industry, the U.S. Supreme Court has taken up a case that could potentially overturn a decision made by the U.S. District Court for the District of Rhode Island. The case in question is Relentless Inc. v. Department of Commerce, where the Rhode Island court had initially required commercial fishing boat owners to pay for the installation of surveillance monitors on their vessels to prevent overfishing.

The Rhode Island court's decision, reaffirmed this summer for a second time, has now become the focus of an ongoing legal battle in a federal appeals court. The fishing industry, represented by the New Civil Liberties Alliance, is challenging the court's decision, arguing that it should be based on the Supreme Court's "best" reading of the statute, as opposed to the previous Chevron deference.

The Chevron deference, a decades-old legal theory, had previously allowed courts to defer to federal agencies' reading of ambiguous laws. However, the fishing industry's successful argument before the Supreme Court last year led to the demise of this theory.

The Supreme Court's new stance is a departure from the Chevron deference and forms the basis for the fishing industry's appeal against the Rhode Island court's decision. If successful, this could have broader implications for how courts interpret ambiguous laws in the future.

The legal fight over on-board fishing monitors is not just about the fishing industry in Rhode Island.
