Second impeachment call against Governor Mutai to be heard in Senate proceedings
Kericho County Governor Faces Second Impeachment Attempt
The Kericho County Governor, Erick Mutai, is currently in the next phase of his impeachment process, following a second attempt by the County Assembly to remove him from office.
On August 18, 2025, the County Assembly delivered the impeachment decision to the office of the Speaker of the Senate, Amason Kingi. The letter included the approved impeachment motion, supporting evidence, and full records of proceedings and notes.
The impeachment motion was introduced by Sigowet MCA Kiprotich Rogony, who accuses Mutai of constitutional violations, illegal tender awards, and misconduct in public office. The motion alleges misappropriation of Sh353 million from the National Agricultural Value Chain Development Project and Sh39 million under the Equaliser Kazi Mtaani Initiative.
The matter is now being moved to the Senate, where members will determine whether the governor will stand trial following this second impeachment attempt. The motion further accuses Mutai of bias in the allocation of the Equaliser Locally-led Climate Action Fund, with his home ward receiving Sh5.7 million in projects while others received none.
The MCAs allege procedural improprieties, lack of transparency, breaches of fair administrative practices, and bias during the proceedings. The Speaker prevented members from adequately expressing their views and failed to maintain neutrality as required by Standing Orders and the Constitution.
During the voting session, electronic voting machines were introduced and used without orientation or testing. This move has been met with criticism from 18 Members of the County Assembly, who have filed affidavits with the Senate, describing the impeachment process as irregular and unconstitutional.
Mutai has dismissed the impeachment as a sham and alleges that the Speaker is responsible for the electronic voting. He claims that the Speaker orchestrated a predetermined outcome via electronic voting, a charge that the Speaker denies.
The central grievance was the sudden introduction of electronic voting machines without prior notice, training, or approval. This marked the second impeachment attempt against Governor Mutai. In October 2024, he survived impeachment after 34 Senators voted to discontinue the hearing.
The motion also accuses Mutai of undelivered animal feed worth Sh14.9 million and overpriced commodities, such as Sh500 sodas and Sh3,250 tissue paper bales. These allegations have not been independently verified.
As the impeachment process moves forward, the Senate will need to decide whether there is enough evidence to proceed with a trial. If found guilty, Mutai could be removed from office and face criminal charges. The outcome of this impeachment attempt will have significant implications for the governance of Kericho County.
