South African Legislature Plans to Introduce Law for Controlling Internet Gaming

The Democratic Alliance (DA) in South Africa has proposed the Remote Gambling Bill in April 2024, aiming to regulate online casinos and interactive gambling legally. This move extends lawful gambling beyond just licensed sports and horse race betting, which are the only permitted online forms under the National Gambling Act.

Key features of the Remote Gambling Bill include:

  1. Regulation of online gambling platforms: The bill provides government oversight for online casinos and interactive gambling, thereby legalizing and regulating these for the first time.
  2. Player protection mechanisms: It mandates tools such as deposit and spending limits, time trackers, self-exclusion options, and cool-off periods to help players control their gambling behavior and prevent excessive gambling.
  3. Protection of minors: Although specific detailed measures were not explicitly outlined, the bill inherently addresses ensuring minors cannot legally access online gambling platforms.
  4. Advertising restrictions: The bill likely includes provisions to limit advertising that targets vulnerable groups, consistent with standard regulatory practices.
  5. Combatting criminal activities: By legalizing and regulating online gambling within South Africa, the bill aims to reduce reliance on offshore, unregulated gambling sites that operate outside the law, which is a step toward combating money laundering, fraud, and criminal exploitation related to illicit gambling.

The drafting and consultations for the Remote Gambling Bill involved experts in gambling and policymaking. The African National Congress (ANC), which has dominated the political scene in South Africa for three decades, has not yet responded publicly to the bill.

The Democratic Alliance officially introduced the Remote Gambling Bill in Parliament after more than two years of drafting and consultations. The DA is the primary opponent of the ANC in the upcoming national and provincial elections.

By regulating online gambling, the Remote Gambling Bill seeks to create a safe, responsible, and regulated online gambling environment with government control measures to protect consumers, especially minors, and curb illegal gambling-related activities.
