In a recent announcement made on Friday, former U.S. President Donald Trump stated that all tariffs he imposed during his tenure remain in effect. The tariffs, which have been a central tool in Trump's trade policy, were primarily justified as a measure to address U.S. trade deficits and ensure national economic security.

The tariffs in question were imposed under the International Emergency Economic Powers Act (IEEPA). They include reciprocal tariffs from April and a separate set from February against China, Canada, and Mexico. Trump has also used tariffs as a means to combat illegal fentanyl exports and pressure other countries to reduce such exports.

However, the U.S. Court of Appeals for the Federal Circuit in Washington, D.C., has ruled that most of the tariffs imposed by Trump are illegal. The court stated that the IEEPA does not explicitly grant the president authority to impose tariffs. The ruling was made on the grounds that the statute does not provide the necessary congressional authorisation for such actions.

Despite the court's ruling, the tariffs remain in effect until October 14, 2023, to allow the Trump administration to appeal to the U.S. Supreme Court. As of September 2025, the Supreme Court of the United States has not yet made a decision on the appeal against the U.S. Court of Appeals' ruling in the tariff case; the case could still reach the Supreme Court eventually, but a specific decision date has not been reported.

The announcement was made on Trump Social, a social media platform. The news has sparked debate and discussion among economists, politicians, and the general public regarding the legality and effectiveness of Trump's tariff policy.

As the legal battle continues, the impact of these tariffs on the U.S. economy and international trade relations remains uncertain. The outcome of the case could set a precedent for future presidential actions regarding tariffs and economic policy.
