The Attorney General, Merrick Garland, has been tasked with leading the investigation. He is to submit a report on the progress of the investigation by December 1, 2023. The Director of the Office of Management and Budget and various executive departments or agencies, including their heads, are also among the individuals or entities directed to act in response to this memorandum.

The memorandum does not create any enforceable rights or benefits for any party, nor does it affect any existing laws or regulations beyond those specified in the memorandum. It is subject to applicable law and the availability of appropriations.

Federal law places strict limitations on the use of Federal grant funds, and in many instances, prohibits grantees from lobbying with appropriated funds or supporting political candidates or parties with grant funds. The Attorney General is not the only individual or entity directed to act in response to this memorandum. Executive departments or agencies, or the heads thereof, are also instructed to take necessary actions in response to the findings of the investigation. The functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals are relevant to this memorandum.

The implementation of this memorandum does not affect any existing laws or regulations. However, it does serve as a reminder of the importance of transparency and accountability in the use of taxpayer funds. The memorandum is a significant step towards ensuring that federal funds are used in accordance with the law and for the benefit of the American people.
