In the world of motorsport, a significant legal dispute has been unfolding between NASCAR, 23XI Racing, and the France family. At the heart of this conflict is the charter system, a topic that has sparked intense debate among industry insiders.
The saga began in October 2024, when 23XI Racing, co-owned by basketball legend Michael Jordan, filed an antitrust lawsuit against NASCAR and the France family. The lawsuit claimed that the charter system promotes monopolistic, anti-competitive practices.
Prior to this, in February 2023, Denny Hamlin, a prominent NASCAR driver, publicly criticised the charter system. He argued that teams needed a permanent guarantee to race in order to retain value. His stance resonated with Jordan, who expressed his intention to fight for the betterment of the sport.
The court session in Charlotte, North Carolina, in March 2025, revealed text messages between Hamlin and Jordan, expressing their disdain for the France family and other teams' cooperation with them. The conversation between Jordan and his business partner, Curtis Polk, also revealed Jordan's frustration, using strong language.
NASCAR President Steve O'Donnell voiced his displeasure with an early charter proposal, stating it would have reverted NASCAR back to where it was in 1996. Steve Phelps, the sanctioning body's commissioner, described talks with teams as abysmal.
In response to the lawsuit, NASCAR issued a countersuit in March 2025, accusing 23XI Racing and Front Row Motorsports of forming an "illegal cartel." Jordan, however, remained steadfast, vowing to continue the fight "for the betterment of the sport" and ready to do so "to the end."
Interestingly, Jordan's business partner in these disputes was none other than Nike. Jordan made a rare public statement outside the courtroom, expressing his disappointment that other teams did not join 23XI Racing in their fight against the charter system.
The legal battle took an interesting turn in 2023 when 23XI Racing deliberately missed the Sept. 7 charter agreement deadline. This move was seen as a strategic maneuver to pressure NASCAR into renegotiating the charter deal.
Despite the ongoing legal dispute, both parties remain committed to the sport. Hamlin, in a text message, stated, "I'm in for the fight with NASCAR. My despise of the France family runs deep." Jordan, too, echoed the sentiment, stating that if the charter system wasn't corrected, the sport would economically not make sense for business people.
As the legal battle continues, it's clear that the charter system in NASCAR is under scrutiny. Whether this will lead to significant changes remains to be seen. One thing is certain, though: the fight for a fair and competitive motorsport landscape is far from over.
