A lawsuit over a perilous elevator ride
Woman Files Lawsuit Against Palms and Otis following a 22-story Elevator Plunge at the Vegas Casino-Resort.
The condominium complex, Palms Place, is embroiled in a civil case alleging negligence, following a horrific incident involving an elevator at the Palms Casino Resort in Las Vegas.
Rebecca Keith Wood filed an updated lawsuit in the Clark County District Court last week, accusing Palms and Otis Elevator Company of negligence. The lawsuit claims that an elevator fell a staggering 22 stories, causing Wood severe injuries.
Neglecting maintenance and inspections
Wood asserts that both Palms and the elevator company overlooked their duty to maintain, inspect, and ensure the safety of the elevators on their Vegas property. She is seeking "financial compensation in excess of $15,000 for general and specific damages, along with attorney's fees."
The alleged incident occurred in May 2023, while Wood was staying at Palms as a guest.
The accident's murky details
Although the Las Vegas Review-Journal reported Tuesday that Wood suffered "serious injuries," it remains uncertain whether she was inside the elevator when it fell or nearby.
Potentially life-altering injuries
The civil complaint indicates that Wood sustained injuries to her bodily limbs, organs, and nervous systems, some of which may be permanent and debilitating.
Wood's lawsuit accuses Palms and Otis of breaching their duty of care by failing to warn guests about the alleged dangerous condition of the elevators. Additionally, the lawsuit alleges that the defendants should have conducted routine inspections to maintain the elevator's safety and operational status.
Tightening the legal knot
Wood's lawsuit has undergone several modifications. Initially, Wood sued the off-Strip casino-hotel, its "listed owners" FP Holdings L.P., Otis, and TK Elevator Corporation in her original suit filed on March 3. However, the amended suit on March 14 removed TK from the case, and the most recent amended complaint on March 20 named Palms Place as a defendant instead of the former owners, Station Casinos.
Palms Casino Resort and Palms Place are currently owned and operated by the San Manuel Band of Mission Indians, who purchased the property from Station Casinos for a whopping $650 million in May 2021.
Neither Palms, its attorney, nor Wood's legal team responded to requests for comment from the LVR-J.
